After Mark and Patricia McCloskey chose to defend their St. Louis home from violent rioters with firearms, they–not the rioters–were targeted by the city’s prosecutor, Kim Gardner. Gardner accused the McCloskeys of making the trespassers who tore down the McCloskey’s gate “fear for their safety.” Wasn’t that the point?
New developments including the intervention of Missouri Attorney General Eric Schmitt into the case, and a promise from Missouri Governor Mike Parson to pardon the couple if convicted, make it unlikely the McCloskeys will see any jail time. But, even the thought that the McCloskeys could be prosecuted for protecting their home and family sets a bad precedent. The Wall Street Journal editorial board writes:
Even if the charges are dismissed, or the McCloskeys are pardoned after being convicted, again we have a public official responsible for upholding law and order wink at a mob while treating law-abiding citizens as criminals. If police cannot be counted on to deal with mobs, it’s even more vital that law-abiding Americans are free to exercise their Second Amendment right to protect themselves.
